Can foreigners legally get married in France?
International couples can legally marry in France only when they meet the French civil requirements that apply to their situation.
Only a civil ceremony performed by the mayor or another authorized civil officer at a mairie is legally recognized in France. To marry in a particular commune, at least one partner must normally have a qualifying domicile or residence there. In some circumstances, the domicile or residence of a parent may also provide the required connection.
French law does not impose a universal 40-day residence requirement. When eligibility is based on residence, it must be established by at least one month of continuous habitation by the date the marriage banns are published.
The couple must provide evidence accepted by the mairie. A hotel reservation or a short tourist stay should not be assumed to meet this condition.
For two foreign citizens who live outside France and have no qualifying connection to a French commune, a civil wedding in mainland France is generally not available. Couples should not assume that their embassy can perform the marriage. The U.S. Department of State, for example, confirms that U.S. embassy and consulate employees cannot officiate marriages abroad.
Most international couples therefore complete their legal marriage in their country of residence and organize a symbolic ceremony in France. This option offers more freedom over the venue, timing and content of the ceremony.
